§ 62-138. Permit denial.

(a)

The city secretary shall deny an application for a permit if the city secretary finds any of the following:

(1)

The applicant failed to furnish the city with all information required by section 62-132;

(2)

The applicant has conducted four or more garage sales at the address during the preceding 12-month period; or

(3)

Evidence that the garage sale will not be conducted in accordance with this article or any ordinances or laws of the city or state.

(b)

The city secretary shall note the reasons for denial on the application and shall notify the applicant of the denial by mailing notice to the applicant at the address shown on the application.
