Chapter 62. OCCUPATIONAL LICENSES AND REGULATIONS |
Article VII. GARAGE SALES |
§ 62-132. Applications.
(a)
A person desiring a permit to conduct a garage sale shall file a written application with the city secretary. The application must be on a form provided by the city secretary and include the following information:
(1)
The complete name and address of the applicant or, if the permit is for a joint garage sale, the name and address of every person sponsoring the proposed sale.
(2)
The address at which the garage sale is to be held.
(3)
Proof that the applicant (or if a joint garage sale, one of the applicants) resides on the premises where the garage sale will be held.
(4)
The date(s) upon which the garage sale is to be held.
(5)
The date(s) of any other garage sales in which the applicant has participated or that the applicant has conducted within the previous 12-month period.
(6)
Such other and additional information as the city secretary may deem necessary to assure that the applicant meets the requirements of this article.
(b)
Applications for all permits shall contain the statements that:
(1)
"I understand that the permit applied for shall be subject to all the provisions and regulations of the City Code and all other ordinances of the city and laws of the state, and I certify that I and all of my assistants, agents, and operators will comply with said ordinances and laws"; and
(2)
"The property to be sold at the garage sale is personal property that I own and that was neither acquired nor consigned for the purpose of resale."

The application shall be signed and sworn to by the applicant before a notary public.
