§ 98-313. Appeal.

  • If the approving authority denies the issuance of a permit, or revokes a permit, he shall sent to the applicant, or permit holder, by certified mail, return receipt requested, written notice of his action and the right to an appeal. The applicant, or permit holder, may appeal the decision of the approving authority to a permit and license appeal board known as the sanitary waste appeal board. The said board shall consist of three members to be appointed by the city council for two-year terms. The board shall adopt its own rules, not inconsistent with this article, designed to give a fair hearing to aggrieved persons wishing to appeal. If the board finds that the approving authority has acted arbitrarily and capriciously, it is empowered to overrule or modify the decision of the approving authority. The filing of a request for an appeal hearing with the permit and license appeal board stays an action of the approving authority revoking a permit until the permit and license appeal board makes a final decision.
