§ 66-154. Restaurants.

  • (a)

    All nonsmoking areas located within a restaurant or any establishment where food is served must:

    (1)

    Be clearly designated by appropriate signs visible to patrons within the dining area indicating that the area is nonsmoking; and

    (2)

    Have ashtrays or other suitable containers for extinguishing smoking materials at the perimeter of the patio smoking area if the owner or operator has permitted smoking in that area pursuant to subsection 66-152(c).

    (b)

    Each restaurant or any establishment where food is served which has a dining area shall:

    (1)

    Have and implement a written policy on smoking which conforms to this section;

    (2)

    Make the policy available for inspection by employees and the City or the City's authorized representatives; and

    (3)

    If smoking is permitted in any outdoor patio area that is at least 25 feet from any public entrance or exit, operable window, or ventilation system, have signs clearly indicating that all seating areas other than the designated patio areas are nonsmoking.

    (c)

    Non-dining areas of any restaurant or any establishment where food is served affected by this section to which patrons have general access, including, but not limited to, food order areas, food service areas, restrooms, and cashier areas, shall be nonsmoking areas.
