  • Limitations on reapplication. In order that zoning may promote the stability and well-being of the community and may offer certainty to the citizens of the city with respect to the use and development of property, the following requirements shall govern the filing of reapplication for zoning changes. When the applicant has withdrawn his proposal at or after the planning and zoning commission meeting thereon, or when the city council has denied a proposal, no reapplication requesting the same zoning classification shall be accepted by the city or scheduled for hearing by the planning and zoning commission within a period of 12 months of the council's denial or applicant's withdrawal when the city council accepts the withdrawal or denies the proposal without prejudice. Provided, however, on receipt of a request stating how conditions have changed substantially within the community since the prior denial or withdrawal, the planning and zoning commission may waive the mandatory delay period and authorize the acceptance of a new application.
