§ 28. Definitions.

    Purpose. For the purpose of this ordinance certain terms and words are herewith defined as follows:

    [B.]

    Generally. Words used in the present tense include the future; words in the singular number include the plural, and words in the plural number include the singular; the word "building" includes the word "structure," the word "shall" is mandatory, and not directory. The words "used" or "occupied" include the words "intended", "designed," or "arranged to be used or occupied." The word "lot" includes the words "plot" or "parcel".

    Abutting, adjacent, adjoining. Contiguous or sharing a common border or boundary with other property. Abutting, adjacent and adjoining shall include property immediately across an alley, but shall not include property across a street.

    Accessory buildings. A subordinate structure detached from but located on the same lot as the primary structure, the use of which is incidental and accessory to that of the principal structure.

    Accessory use. A subordinate use customarily incident to and located on the same lot occupied by the main use; or a use customarily incident to the main or principal use of the property.

    Advertising agency. A business established for the purpose of providing creative and marketing communications services for its clients.

    Airport or landing field. An area improved for the landing or takeoff of aircraft, approved by the Federal Aviation Administration for operation as an airport.

    All-weather hard surface. A permanent surface that as a minimum is a three-inch base course (tightly compacted rock) with a small layer of emulsion (seal coat) applied to the surface, is constructed such that it drains appropriately, remains water resistant, is free of litter, debris, weeds, grass or other objectionable materials or objects and is visibly dust free.

    Alley. A public minor way that is used primarily for vehicular service access to the back or side properties otherwise abutting on a street or highway.

    Animal hospitals, small animal. Hospitals, veterinarian offices, or clinics for the care, grooming, and temporary boarding of domestic household pets. Such facilities must comply with the following provisions:

    (1)

    Activities must be conducted totally within a completely enclosed, sound proof, and air conditioned building;

    (2)

    All noise and odors created by the activities within the building shall not be perceptible from beyond the property line; and

    (3)

    No animals are to be kept outside the building at any time.

    (4)

    No boarding of any animals.

    Animal hospitals, large animal. Hospitals, veterinarian offices and clinics with outside treatment pens for the care and temporary boarding of household pets, or livestock (horse, pony, mule, donkey, sheep, goat, or cow).

    Animal race track. An outdoor track for the purpose of riding or racing horses and other animals normally used in racing.

    Antenna. An exterior device designed for telephonic, radio, data, television, or video communications through the sending or receiving of electromagnetic waves.

    Antenna, building attached. Antenna attached to existing structures in two general forms:

    (1)

    Roof-mounted, in which antennas are placed on the roofs of buildings; or

    (2)

    Building mounted, in which antennas are mounted to the sides of buildings.

    These antenna can also be mounted on structures such as water tanks, billboards, church steeples, electrical transmission towers, etc.

    Antenna, commercial. See Section 29, Supplementary district regulations, [subsection] R. Transmitting and Receiving Antennas and Antenna Facilities, 2. Definitions.

    Antenna equipment storage. A small, single story equipment building less than 500 square feet in size used to house radio transmitters and related equipment.

    Antenna facility. A building or independent support structure (including, but not limited to, a tower) used for mounting antennas, along with an associated and necessary equipment building. An antenna facility shall consist of only one tower.

    Antenna, microwave. Also known as "dish" antenna. A dish shaped antenna used to link communications sites together by wireless transmission of voice or data, utilizing electromagnetic radiation frequencies from three GHz to 300 GHz; and using relatively low transmitter power levels when compared to other forms of transmission.

    Antenna, panel. Also known as "directional" antenna. An antenna or array of antennas designed to concentrate a radio signal in a particular area. Panel antennas are typically flat, rectangular devices approximately six square feet in size.

    Antenna, whip. Also known as "omni directional" antenna. Shaped cylindrically, whip antennas have diameters between two and six inches, and measure between one and 18 feet in height. They are used to emit signals in a 360-degree horizontal plane and a compressed vertical plane.

    Antique shops (see retail store). An establishment offering for sale articles such as glass, china, furniture, or similar furnishings and decorations that have value and significance as a result of age, design or sentiment.

    Apartment. A room or suite of rooms designed as a dwelling unit to accommodate one family and containing one or more kitchens, one or more bathrooms, and one or more bedrooms.

    Apartment hotel or extended stay hotel. One or more buildings containing individual living units intended or designed to be used, or which are used or hired out for compensation to be occupied, or which are occupied, for sleeping purposes by transient guests, including for stays in excess of thirty (30) consecutive days, but not as a permanent residence, and which may provide provisions for personal services and contain kitchen facilities for food preparation, including, but not limited to, facilities such as burners, stoves, or ovens.

    Apartment house, cottage house, or row house. Any building with a series or row of separate apartments that share side walls and occupied by families living independently of each other.

    Appliance repair and installation. An establishment specializing in the repair and installation of electrical and gas household appliances.

    Appliance sales. A shop offering for sale to the public electrical and gas household appliances.

    Area of the lot. The net area of the lot not including portions of street rights-of-way or alleys.

    Asphalt or concrete batching plant (see cement plant).

    Assembling operations of commodities. Commercial article or agriculture product assembled for commercial/retail purposes. All operations conducted in a fully enclosed building.

    Assisted living facility. A facility intended to provide dwelling units for occupancy by persons requiring the level of care and support defined by the State of Texas as "supervised living".

    Auditorium, theaters, cinemas. An establishment offering motion pictures or live theater for viewing by the public.

    Automobile accessory sales. A shop with a primary function of selling new parts and accessories, including tires and batteries, for automobiles, small trucks and vans. No repair service is allowed on site.

    Automobile car wash (self service). A facility that provides hand operated equipment for the self-service cleaning, washing, polishing, or waxing of motor vehicles.

    Automobile gasoline sales. An establishment that provides retail sales of gasoline, but does not provide automotive service and repair. The facility may also provide a retail area for convenience sales of other goods and food.

    Automobile laundry and steam cleaning uses. A facility that provides cleaning services for automobiles with the following restrictions:

    (1)

    All automobile laundry and steam cleaning uses shall be completely within a building having not less than two sides.

    (2)

    Vacuuming facilities may be outside the building, but shall not be in the front yard and shall not be closer than 25 feet from "SF-1", "SF-2", "D", "TH", "MF-1", or "MF-2" districts.

    (3)

    The building surfaces shall be faced with masonry, porcelainized steel, baked enamel steel, or other material equal in durability and appearance, which includes tilt wall with exposed aggregate.

    (4)

    The building shall set back not less than 30 feet from the front property line.

    (5)

    All off street parking areas shall be hard-surfaced and dust-free.

    (6)

    Any lights used to illuminate the area shall be directed away from adjacent residential properties.

    Automobile parking area. An area not within a building where motor vehicles may be stored for the purposes of temporary, daily, or overnight off-street parking.

    Automobile sales area. An open area or lot used for the display and/or sale of automobiles, where no repair work is permitted except minor reconditioning of the cars to be displayed and/or sold on the premises, and no dismantling, sale, or keeping of used cars or junk on premises.

    Automobile service station. Also referred to as a filling station. Any premises where gasoline and other petroleum products are sold, services such as greasing, oil change, and washing is performed, and/or light maintenance activities such as engine tune-ups, lubrication, minor repairs, and carburetor cleaning are conducted. Filling or service stations shall not include premises where heavy automobile maintenance activities such as but not limited to engine overhauls, automobile painting, body, and/or fender work are conducted.

    Automobile service and repair garage. An establishment that provides, as its primary use, major engine repair and specialty automotive repair, installation, and service, including engine overhaul, transmission repair, brake repair, muffler repair, and similar automotive establishments as interpreted by the zoning administrator. These facilities often require vehicles to be kept for longer periods than 24 hours.

    Automobile paint and body. An establishment that provides as its primary use automotive painting and body work. The establishment must have a paint booth which meets all city codes.

    Automobile tune-up and lubrication service. An establishment that provides activities such as engine tune-ups, lubrication, and automobile fluid servicing. All services on a vehicle shall be completed within one hour. All service and storage of vehicles must be indoors.

    Automobile upholstery shop. An establishment that provides activities such as auto upholstery and trim repairing on vehicles. All services on a vehicle shall be completed indoors. All service and storage of vehicles must be indoors.

    Backhaul network. The lines that connect a provider's towers/cell sites to one or more cellular telephone switching offices, and/or long distance providers, or the public switched telephone network.

    Bakery plant, wholesale and retail. A facility that primarily produces large quantities of baked goods for retail and/or wholesale distribution off of the premises. Maximum floor area exceeds 3,000 square feet.

    Bakery, retail. A shop offering for retail sale, on premises, those baked goods or candies made on premises or off-premises. Maximum floor area shall not exceed 3,000 square feet.

    Banquet Hall: An establishment that is leased on a temporary basis before the day of the event by individuals or groups who reserve the facility to accommodate private functions, including, but not limited to, banquets, weddings, anniversaries, receptions, business and organizational meetings, and other similar functions, to which the general public is not admitted and for which no admission charge is imposed. Such establishments may include kitchen facilities for the preparation of food or catering of food and areas for dancing, dining, and other entertainment activities that customarily occur in association with said functions.

    Barber shop/beauty salon: An establishment that provides personal services such as haircuts, braiding of hair, weaving of hair, perms, color treatments, manicures, pedicures, skin care, permanent cosmetics, tanning, noninvasive and/or nonaggressive dead skin exfoliation and hair removal, body wraps, esthetician specialties and cosmetology procedures. Tattoo studio, dental procedures, and medical procedures are not included in this definition as primary or accessory uses.

    Basement. A building story which is partly underground but having at least one-half of its height above the average level of the adjoining ground. A basement shall not be counted as a story in computing building height.

    Bed and breakfast inn (see section 29). A house, or portion thereof, where short-term lodging rooms and meals are provided. The operator of the inn or a caretaker shall live on the premises or an adjoining premises. The following provisions shall apply:

    (1)

    Additional parking of one space per rented bedroom will be required for any bed and breakfast with more than four rented bedrooms. If additional parking is provided, it must be screened from view of any adjacent residentially zoned property.

    (2)

    The applicant must address the issue of increased traffic to the satisfaction of the planning and zoning commission and the city council.

    (3)

    Food service will be limited to overnight guests of the bed and breakfast establishment and shall be prepared on site, with the exception of receptions, retreats, teas, and luncheons that may be catered.

    (4)

    In keeping with the residential character, retail sales shall be limited to those items for the immediate needs of the establishments clients and handicraft items or those items associated with the bed and breakfast establishment.

    (5)

    Any structural changes and any signage proposed must maintain the residential character of the neighborhood and must receive prior approval of the city council upon recommendation by the planning and zoning commission.

    (6)

    A permanent wired smoke alarm system meeting all city codes must be installed in the facility.

    (7)

    Bed and breakfast establishments will be limited to receptions, retreats, teas, and luncheons of no more than 30 persons.

    Bicycle sales and repair shop (see retail store). A shop that includes the display and sale of new or used bicycles with accessory sales and maintenance or repair facilities.

    Bingo hall. A facility where bingo is played, with proceeds going to charity as defined in chapter 78 in this Code, but not including the use of player operated video terminals or slot machines.

    Block. An area enclosed by streets and occupied by or intended for buildings; or if said word is used as a term of measurement, it shall mean the distance along a side of a street between the nearest two streets that intersect said street on the said side. In cases where platting is incomplete or disconnected the zoning administrator shall determine the outline of the block.

    Board. The zoning board of adjustment as established in section 35.

    Boarding home facility. An establishment defined by Texas Health and Safety Code, Chapter 260, as amended.

    Boarding house or lodging house. A building other than a hotel, motel, extended stay hotel, apartment hotel, bed and breakfast inn, apartment house, boarding home facility, community home, or apartment, providing lodging with or without meals, and for compensation or through a nonprofit organization, for five (5) or more persons unrelated by blood, marriage, adoption, or guardianship. A boarding house or lodging house includes, but is not limited to, uses such as fraternity houses, sorority houses, and dormitories.

    Boat sales, service and repair. The sale, service or repair of boats and marine craft within a structure, with outside display allowed.

    Bottling plant (see assembling of commodities).

    Bowling alley. An establishment engaging in providing facilities for bowling.

    Book or stationery store or newsstand (see retail store). A business establishment offering for sale articles such as books, stationery, cards, newspapers or magazines, gifts, or other similar items or a combination thereof.

    Breezeway. A covered passage one story in height and six feet or more in width connecting a main structure and an accessory building. A breezeway shall not be considered an accessory building.

    Building. Any structure built for the support, shelter and enclosure of persons, animals, chattels or movable property of any kind. When subdivided in a manner sufficient to prevent the spread of fire each portion so subdivided may be deemed a separate building.

    Building area. The portion of a lot remaining after required yards have been provided.

    Building line. A line parallel or approximately parallel to the street right-of-way line at a specific distance therefrom marking the minimum distance from the street right-of-way line that a building may be erected.

    Bus barns or storage. A building or yard area established for the maintenance and storage of buses, truck tractors or tractor trailers.

    Bus passenger terminal. Any premises for the storage or parking of motor-driven buses, and the loading and unloading of passengers.

    Business. Includes local retail, commercial, industrial, and manufacturing uses and districts as herein defined.

    Cabinet shop. A shop for the construction or assembly of cabinetry for domestic use.

    Car title loan business means:

    a.

    An establishment, entity, or person registered with the Texas Secretary of State as a Credit Services Organization (CSO) under V.T.C.A., Texas Finance Code § 393 that engages in any of the following activities:

    1.

    Acts or operates as a loan broker between a consumer and a lending company;

    2.

    Issues a "letter of credit" or similar document on behalf of a consumer to a lending company;

    3.

    Collects any or all of the following fees:

    A.

    A referral fee for referring a consumer to a lending company;

    B.

    An application fee for filling out the CSO documents; or

    C.

    Interest on the funds distributed to the consumer, or payments based on the amount of money distributed to the consumer; or

    b.

    A lending company that uses a consumer's vehicle title as collateral for a loan.

    Carnival. A traveling show featuring exhibits and rides.

    Carpet and tile sales store. A facility primarily engaged in retailing new floor coverings such as rugs and carpets, vinyl floor coverings, and floor tile. Includes some installation and repair.

    Cellar. The designated use of a portion of a building that is partially or wholly below grade and primarily used for storage or home heating appliances. A cellar shall not be counted as a story in computing building height.

    Cement or hydrated lime plant. A manufacturing facility and process for making cement, hydrated lime, and by-products, including storage of product and raw materials.

    Cemetery or mausoleum. An area or structure designed to contain the remains of humans or animals for permanent interment.

    Certificate of occupancy (or permit). An official certificate issued by the city through the building official which indicates conformance with or approved conditional waiver from the building or zoning regulations and authorizes legal use and occupancy of the premises for which it is issued.

    Check cashing business means an establishment, entity, or person registered with the Texas Secretary of State as a Credit Services Organization (CSO) under V.T.C.A., Texas Finance Code § 393 that provides one or more of the following:

    a.

    An amount of money that is equal to the face of the check or the amount specified in the written authorization for an electronic transfer of money, less any fee charged for the transaction;

    b.

    An agreement not to cash a check or execute an electronic transfer of money for a specified period of time; or

    c.

    The cashing of checks, warrants, drafts, money orders, or other commercial paper for compensation by any person or entity for a fee.

    Chiropractic clinic. An establishment where patients go for a system of therapy in which bodily structures such as the spinal column, are manipulated.

    Christmas tree sales. The temporary outside seasonal sale of Christmas trees.

    Circus. An arena, often circular and covered by a tent, in which the public is entertained by featured acts such as acrobats, clowns and trained animals.

    City. The City of Haltom City, Texas.

    City council. The governing body of the City of Haltom City, Texas.

    Cleaner, dry. A retail facility that provides for dry cleaning service, on a drop off and pick up basis. Cleaning may be provided on premises or off premises, however, the maximum floor area shall not exceed 3,000 square feet.

    Clinic. An establishment where patients are admitted for examination and treatment on an outpatient basis by one or more physicians, dentists, other medical personnel, psychologists, or social workers and where patients are not usually lodged overnight. Offices for one or more physicians, surgeons, or dentists engaged in treating the sick or injured, but not including rooms for overnight patients. (See health services facilities).

    Clothing or wearing apparel shop (see retail store). An establishment primarily engaged in retail sales of wearing garments, also providing secondary services such as custom orders, repairs, and alterations of clothing or wearing apparel.

    Clothing manufacturing. A facility engaged in knitting, weaving, printing, dyeing and finishing of clothing, apparel, millinery and canvas products.

    Collector street. As defined by the city's latest approved thoroughfare plan.

    Co-location. The act of locating wireless communications equipment from more than one provider on a single antenna facility.

    Commercial amusement center, indoor operations only: A facility providing for entertainment and amusement. Games contained in the facility may include skilled games or activities such as, but not limited to, shuffle boards, darts, bowling facilities, roller/ice skating rinks, dominos, and arcade/video/computer games. Not included in this definition are games commonly referred to as eight-liners or slot machines or other games of chance resembling machines, dice, card games, or other gambling-like devices.

    Commercial amusement enterprise, outdoor. An amusement enterprise offering entertainment of games of skill to the general public for a fee or charge wherein any portion of the activity takes place outdoors.

    Commercial antenna facility. An antenna facility used for mounting antennas that are operated in the course of business.

    Commercial bingo establishment. A facility licensed and regulated by the State of Texas Lottery Commission for the purpose of operating Bingo games.

    Commercial carpet cleaner (see contractor's).

    Commercial laundry/dying plant (see industrial cleaning plant).

    Commercial vehicle. Any vehicle designed or used primarily for transportation of property or persons for hire with a rated capacity of one ton or more according to the manufacturer's classification or licensed registered weight. A commercial vehicle meeting these criteria may include but shall not be limited to vehicles.

    (1)

    Registered to a business;

    (2)

    Bearing a business insignia; or

    (3)

    Bearing a commercial license plate.

    Commercial vehicles may include but shall not be limited to trucks, tractors, road-tractors, truck-tractors, semi-trailers, tractor trailers, trailers, vans, step-vans, wreckers, motor buses, street or suburban buses, and school buses.

    Community center. A building dedicated to social or recreational activities, serving the city or a neighborhood and owned and operated by the city, or by a non-profit organization dedicated to promoting the health, safety, morals or general welfare of the citizens.

    Community home. A community-based residential home, as defined by Texas Human Resources Code Chapter 123, that is operated by: a) the Department of Aging and Disability Services; b) a community center organized under Subchapter A, Chapter 534, Texas Health and Safety Code, that provides services to persons with disabilities; c) an entity subject to the Texas Nonprofit Corporation Law as described by Section 1.008(d), Business Organizations Code; or d) an entity certified by the Department of Aging and Disability Services as a provider under the ICF-IID medical assistance program. A community home is also considered to be an assisted living facility licensed under Chapter 247, Texas Health and Safety Code, provided 1) that the exterior structure retains compatibility with the surrounding residential dwellings; and 2) the person establishing or operating an assisted living facility holds a license issued under Chapter 247, Texas Health and Safety Code.

    Community welfare shelter. A non-profit facility providing temporary boarding, lodging, counseling, and care to at least one person (and his or her dependents) who may or may not be defined or described as a person with a disability under state or federal law and being a victim of domestic violence and/or an unwed mother of a new born child.

    Comprehensive plan. The Comprehensive Plan of the City of Haltom City, Texas, as adopted by the City Council of the City of Haltom City.

    Concrete mixing plant. A facility primarily engaged in manufacturing portland cement concrete manufactured and delivered to a purchaser in a plastic and unhardened state. This industry includes production and sale of central-mixed concrete, shrink-mixed concrete, and truck-mixed concrete.

    Conditional use. A use which would not be appropriate generally or without certain restrictions throughout a zoning district, but which, if controlled as the number, area, location or relation to the neighborhood would not impair the health, safety and welfare of the community. (See section 36, Conditional uses).

    Condominium. A multi-family dwelling facility within which designated units or apartments are conveyed fee simple title, with an undivided interest in the building's common elements, to include, but not be limited to, halls, stairs, elevators, roofs, parking space, and the land.

    Confectionery store (see retail store). A business establishment offering for sale candy and confectionery products.

    Contractors: Plumbing, electrical, heating, or air conditioning sales. Special trade contractors primarily engaged in the retail sale of plumbing, heating, electrical, and air-conditioning equipment.

    Contractors: Plumbing, electrical and heating appliances, sales and services. Special trade contractors engaged in the installation and repair of plumbing, heating, electrical, and air-conditioning equipment. All storage of materials must be indoors.

    Contractors: Storage or equipment yard. An area of outside storage of construction equipment.

    Convalescent facility. An establishment primarily engaged in providing inpatient nursing and rehabilitative services to patients who require continuous health care, but not hospital services. Medical care must be ordered by and under the direction of a physician. The staff must include personnel qualified in accordance with regulations of the State of Texas.

    Country club. Land area and buildings containing golf courses, recreational facilities, a clubhouse, and customary accessory uses, open only to members and their guests.

    Court. An open, unoccupied space, bounded on three or more sides by the walls of a building. An inner court is a court entirely surrounded by the exterior walls of a building. An outer court is a court having one side open to a street, alley, yard or other permanent space.

    Custom dressmaking, millinery and/or tailor shop. An establishment primarily engaged in the retail sale of specialized lines of apparel and accessories including custom tailoring, and selling men's and women's clothing.

    Dance school. An establishment primarily engaged in operating dance studios and schools as a service to the general public.

    Day care center operated as part of and in a commercial business. An accessory use provided within the facilities of a commercial business where care, protection, and supervision are provided on a regular schedule, at least twice a week to more than 12 children under the State of Texas licensing provisions.

    Day care centers operated as part of and in the facility of a religious institution. An accessory use provided within the facilities of a religious institution where care, protection, and supervision are provided on a regular schedule, at least twice a week to more than 12 children under the State of Texas licensing provisions.

    Day care nursery or school. A facility where care, protection, and supervision are provided on a regular schedule, at least twice a week to more than 12 children under the State of Texas licensing provisions.

    Day care in the home. A home that regularly provides care in the caretaker's own residence for not more than six children under 14 years of age, excluding the caretaker's own children, and that provides care after school hours for not more than six additional elementary school children, but the total number of children, including the caretaker's own, does not exceed 12 at any given time.

    Day Laborer Hall or Temporary Common Worker Employer. Any profit or non-profit public or private entity, whose business involves securing temporary unskilled or agricultural employment for a client through the use of a hiring hall or indoor facility where unskilled workers gather to await employment.

    Delicatessen shop (see restaurant). A shop selling prepared foods such as sandwiches, salads, and soups, etc.

    Density. The number of dwelling units permitted per net acre of land.

    Department store. A store offering a variety of comparison and consumptive goods at a retail price.

    Drug store (see retail store). An establishment offering over the counter and prescription drugs and allied products for retail sale.

    District (zoning). A section of the City of Haltom City, Texas, for which the regulations governing the area, height, or use of the land and buildings are uniform.

    Duplicating, printing, lithography, or copy service. A small commercial printing shop offering duplication services, printing, blueprinting or lithography with floor area not to exceed 2,000 square feet.

    Dwelling, one-family. A residential building other than a mobile home or HUD code manufactured home, designed for and occupied by one family only.

    Dwelling, two-family. A residential building containing two dwelling units designed for occupancy by not more than two families.

    Dwelling, three-family. A residential building containing three dwelling units designed for occupancy by not more than three families.

    Dwelling, four-family. A residential building containing four dwelling units designed for occupancy by not more than four families.

    Dwelling, HUD code manufactured home. A structure that was constructed on or after June 15, 1976, according to the rules of the United States Department of housing and urban development, transportable in one or more sections, which, in the traveling mode is eight body feet or more in width or 40 body feet or more in length, or when erected on site, is 320 or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling with a permanent foundation, connected to the required utilities, and including the plumbing, heating, air-conditioning, and electrical systems.

    Dwelling, mobile home. Mobile home means a structure that was constructed before June 15, 1976, transportable in one or more sections, which, in the traveling mode, is eight body feet or more in width or 40 body feet or more in length, or, when erected on site, is 320 square feet or more, and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air-conditioning, and electrical systems.

    Dwelling, multi-family. A structure(s) or portion thereof used for occupancy by five or more families living independently of each other and containing five or more dwelling units.

    Dwelling unit. One room, or rooms connected together, constituting a separate, independent housekeeping establishment for owner occupancy, or rental or lease on a weekly, monthly, or longer basis, and physically separated from any other rooms or dwelling units which may be in the same structure, and containing independent cooking and sleeping facilities, with a common shared entrance providing shared access throughout the dwelling unit.

    Easement. A grant of one or more of the property rights by the owner to, or for the use by, the public, a corporation, or another person or entity.

    Efficiency apartment. An apartment having a combination living and bedroom (no separate bedroom).

    Electronic manufacturing. (See light fabrication and assembly)

    Electronic vaping device. Any electronically powered or battery powered device designed to simulate the smoking of tobacco, cigarettes, pipes or cigars. An electronic vaping device includes personal vaporizers, electronic cigarettes (e-cigarettes), electronic pipes (e-pipes), electronic cigars (e-cigars) and any other type of electronic nicotine delivery system or any part thereof.

    Family. One or more persons related by blood, marriage, guardianship, or adoption, or a group of not more than four (4) persons unrelated by blood, marriage, guardianship, or adoption, occupying a single dwelling unit and expressly excluding occupants of a lodging house, boarding house, fraternity house, and sorority house.

    Farm or ranch (minimum five acres). A parcel of land used for agricultural activities.

    Farm, truck garden, orchard or nursery (see section 29). An area which is used primarily for the purpose of growing of farm products, vegetables, fruits, trees and grains, and including the necessary accessory uses for raising, treating, and storing products raised on the premises, but not including any type of agriculture or husbandry specifically prohibited by ordinance or law. The following provisions shall apply:

    (1)

    Does not include retail or wholesale business sales offices maintained on the premises;

    (2)

    No obnoxious fertilizer may be stored upon the premises; and

    (3)

    No obnoxious fertilizer processing may be conducted on the premises.

    Farm implement sales, service, or rental. A facility providing the sale, service or rental of farm implements, requiring outside storage and display.

    Farmers' market. A place or structure for the display and sale of farm products.

    Financial institution/bank or savings and loan means a building or premise offering banking, savings and loan, and other financial services, not including pawn shops or nondepository financial institutions as defined herein.

    Fire station. A building housing fire equipment and firefighters.

    Flood plain. An area identified by the Federal Emergency Management Agency as possibly being flood prone or below the intermediate flood line (100-year flood plain). The issuance of building permits for construction of any structure within such flood plain is regulated by separate specific ordinance governing the safeguards, preventive actions against flooding, types of uses permitted in flood prone areas, etc.

    Floodway (regulatory floodway). The channel of a river or watercourse and the adjacent land areas that must be reserved in order to discharge the base flood without cumulatively increasing the water surface elevation more than a designated height.

    Floor area. The total (gross) square feet of floor space within the outside dimensions of a building including each floor level, but excluding cellars, attics, porches, carports or garages that are not designed for residential or business occupancy.

    Floor area ratio (FAR). An indicated ratio between the numbers of square feet of total floor area in the main building(s) on a lot and the total square footage of land in the lot; the number resulting from dividing the main building floor area by the lot area.

    Florist (see retail store). A shop offering flowers, flower arrangement services, and associated products for sale.

    Food processing plant. An establishment in which food is processed or otherwise prepared for eventual human consumption but not consumed on the premises.

    Fraternal organization, civic club, or lodge. A social club, fraternity, sorority lodge or similar organized group having a restricted membership and specific purpose related to the welfare of its members or the community, excluding those whose chief activity is a service customarily carried on as a business.

    Freight terminal—Rail or truck. An area devoted to the storage, handling and receipt of railroad or truck freight from firms engaging in interstate and intrastate commerce.

    Frontage. All the property abutting on one side of the street between two intersecting streets, measured along the street line.

    Frozen food locker. A facility for the storage of frozen food for retail sale for individual or family use, not including food processing except cutting or wrapping.

    Furniture manufacturing plant. Facility where the manufacturing of a product from processed wood into finished furniture product. May produce noise, vibration or particulate. This use will also include packaging of the finished product.

    Garage apartment. An apartment built on top of a house. If the garage is attached, it will have a separate entrance and may or may not have a communicating door with the primary structure. Also called a "mother-in-law" dwelling unit, a small apartment accessory to a larger primary structure.

    Garage, commercial parking. A building or portion thereof, other than a residential garage, used exclusively for parking or storage of self-propelled vehicles, but with no other services provided except facilities for washing.

    Garage, private. An enclosed accessory building for storage only of motor vehicles, boats, travel trailers, and household goods owned and used by the owners or tenants of the premises.

    Garage, residential. A residential accessory building designed for the storage of personal automobiles not exceeding one story and 1,000 square feet.

    Gift shop (see retail store). A small retail establishment offering specialty items, greeting cards, or stationary to the general public.

    Golf course, private. Private grounds and facilities, on a site containing a total area of not less than 40 acres, primarily engaged in the operation of a golf course restricted to use by members and their guests.

    Golf course, public. Public grounds and facilities primarily engaged in the operation of a golf course open to the general public typically on a fee basis.

    Golf course—Miniature, driving tee, driving range and pitch and putt course. A commercial facility offering miniature golf, driving tees, driving range, and pitch and putt courses to the general public on a fee basis.

    Grade.

    (1)

    For buildings having walls adjoining one street only, it is the elevation of the sidewalk at the center of the wall adjoining the street;

    (2)

    For buildings having walls adjoining more than one street, it is the average of the elevation of the sidewalk at the center of all walls adjoining the street; and

    (3)

    For buildings having no wall adjoining the street, it is the average level of the finished surface of the ground adjacent to the exterior wall of the building.

    Any wall approximately parallel to and not more than five feet from a street line is to be considered as adjoining the street. Where no sidewalk has been constructed, the building official shall establish such sidewalk level or its equivalent for the purpose of these regulations.

    Greenhouse. An accessory structure located on the same lot with a primary residential structure for the storage, growing, and care of plant materials, not greater than 120 square feet in floor area and a maximum of 12 feet in height.

    Grocery store and meat market. A retail establishment offering for sale fresh fruits and vegetables, prepackaged food products, household items, and other goods commonly associated with the same.

    Hardware, dry goods, paint, wallpaper store, and other home improvement items. A retail establishment offering hand tools, building materials, paint, wallpaper, tile and other home improvement items for sale.

    Handicapped. The term "handicapped" shall mean having: 1) a physical or mental impairment that substantially limits one or more of such person's major life activities to the extent that such person is incapable of living independently; 2) a record of having such an impairment; or 3) being regarded by the medical profession as having an impairment. However, "handicapped" shall not include current illegal use of or addiction to a controlled substance, including alcohol, nor shall it include any person whose residency in the home would constitute a direct threat to the health and safety of other individuals.

    Hatchery. A facility for the incubation, hatching, and short term care of all types of fish or domestic poultry, game birds, fowl, i.e., pheasants, quail, turkey, etc.

    Hauling and storage company. An industrial facility offering hauling and storage services to the public.

    Health and physical fitness center. A facility offering equipment for athletic activities such as aerobic classes, swimming, basketball, racket sports, weight lifting and other activities meant to improve the physical health of users.

    Health service facilities. A facility offering medical, dental, chiropractic, optometric, podiatric, and other similar services including offices, clinics, and associated laboratory services.

    Heavy machinery sales, service, or rental. A facility for the storage, repair, outside sales or rental of heavy machinery or equipment (15,000 lbs or greater).

    Height of buildings. The vertical distance of a building measured five feet from the average natural front yard ground level, to 1) the highest point of the roof's surface, 2) the deck line of mansard roofs, or 3) the mean height level between eaves and ridge for hip and gable roofs and, in any event, excluding chimneys, cooling towers, elevator bulkheads, tanks, water towers, radio towers, ornamental cupolas, domes or spires, and parapet walls not exceeding ten feet in height.

    Height of yard or court. The vertical distance from the lowest level of such yard or court to the highest point of any boundary wall.

    Helipad. A landing pad for rotary wing aircraft not exceeding a gross weight of 6,000 pounds, including fueling facilities; used to load and unload passengers or air express but not used for regularly scheduled stops.

    Hobby. An accessory use housed in a dwelling or in an accessory building in which the residents of the premise engage in recreational activities, none of which shall disturb the neighbors thereof and from which no compensation, revenue, or value may be derived, and in which no goods may be publicly displayed, offered for sale or advertised for sale, nor may any sign be used in connection therewith. (See home occupation)

    Home occupation. An occupation conducted in a dwelling unit or accessory building, provided that:

    (1)

    No person other than members of the family residing on the premises shall be engaged in such occupation;

    (2)

    The use of the dwelling unit for the home occupation shall be clearly incidental and subordinate to its use for residential purposes by its occupants, and not more than 20 percent of the floor area of the dwelling unit, not including the garage or accessory structure, shall be used in the conducting of the home occupation;

    (3)

    There shall be no change in the outside appearance of the building or premises, or other visible evidence of the conduct of such home occupation. No sign advertising a home occupation shall be placed on property where a home occupation is conducted;

    (4)

    There shall be no sales from the dwelling in connection with such home occupation. Any sales shall be clearly secondary;

    (5)

    No traffic shall be generated by such home occupation in greater volumes than would normally be expected in a residential neighborhood, and any need for parking generated by the conduct of such home occupation shall be met off the street and other than in a required front yard;

    (6)

    No equipment, process or work shall be used or conducted in such home occupation that creates noise, vibration, glare, fumes, odors, or electrical interference detectable to the normal senses off the lot, if the occupation is conducted in a residence. In the case of electrical interference, no equipment, process or work shall be used or conducted which creates visual or audible interference in any radio or television receivers off the premises, or causes fluctuations in line voltage off the premises;

    (7)

    The operation of a beauty salon, barber shop, pet grooming establishment, or repair services shall not be permitted as a home occupation; and

    (8)

    No outdoor storage of any type shall be permitted with any home occupation.

    Hotel or motel (see section 29). One or more buildings containing individual living or sleeping units especially designed as temporary quarters for transient guests, including provisions for meals and personal services. A hotel includes a tourist hotel, a motor hotel, and a motel, but does not include an apartment hotel. In addition, a conditional use shall apply when located in the "C-2", "C-3" and "C-4" zoning districts:

    (1)

    No building or outside activities or facilities including dumpsters, mechanical, storage or maintenance buildings or equipment, or recreation areas, except surface parking shall be less than 50 feet from any residential district.

    (2)

    No building shall exceed 2½ stories nor shall it exceed 35 feet within 100 feet of any residential zoned property.

    (3)

    Any external lighting shall be mounted and maintained in a manner to not illuminate any adjacent residential zoned property.

    Hotel, apartment. One or more buildings containing individual living units especially designed as longer term temporary quarters for transient guests. May include provisions for meals and personal services.

    Hospital. An institution specializing in giving clinical, temporary, and emergency services of a medical or surgical nature to human patients and injured persons, and licensed by state law to provide facilities and services in surgery, obstetrics, and general medical practice.

    Household and office furniture, furnishings, and appliances (see retail store). A retail establishment offering home and office furnishings and appliances for sale to the general public.

    Household Laundry Service Facility: A commercial establishment where clothes and other household fabrics can be washed and dried, primarily using coin-operated machines or other means of self-service laundry. Also known as washaterias, laundromats, launderettes, and lavanderias.

    Impervious surface. Any material that substantially reduces or prevents the infiltration of storm water into previously undeveloped land.

    Industrial cleaning plant. A facility utilizing specialized processes that include the use of chemicals and solvents for the purpose of cleaning items, which includes but is not limited to clothing. Requires the storage of said chemicals and solvents and possible discharge of waste products; however, all discharges are subject to strict control by all local, state, and federal discharge and storage regulations.

    Industrialized housing. A residential structure that is designed for the use and occupancy of one or more families, that is constructed in one or more modules or constructed using one or more modular components built at a location other than the permanent residential site, and that is designed to be used as a permanent residential structure when the modules or modular components are transported to the permanent residential site and are erected or installed on a permanent foundation system. The term includes the plumbing, heating, air-conditioning, and electrical systems. The term does not include any residential structure that is in excess of three stories or 49 feet in height as measured from the finished grade elevation at the building entrance to the peak of the roof. The term shall not mean nor apply to (i) housing constructed of sectional or panelized systems not utilizing modular components; or (ii) any ready made home which is constructed so that the entire living area is contained in a single unit or section at a temporary location for the purpose of selling it and moving it to another location.

    Janitorial supply. (See retail store).

    Jewelry store, optical goods (see retail store). An establishment offering jewelry, watches, glasses, and/or other similar products and associated products for sale.

    Junk. The term "junk" is defined to mean and shall include scrap iron, scrap tin, scrap brass, scrap copper, scrap lead or scrap zinc and all other scrap metals and their alloys, and bones, rags, used cloth, used rubber, used plastic, used rope, used tinfoil, used bottles, old cotton, or used machinery, used tools, used appliances, used fixtures, used utensils, used boxes or crates, used pipe or pipe fittings, wrecked, unlicensed or un-inspected automobiles, airplanes, tires, and other manufactured goods that are determined by code enforcement to be so worn, deteriorated or obsolete as to make them unusable in their existing condition; subject to being dismantled for junk.

    Kennel (also dog training school). Any lot or premises on which four or more dogs, cats, or other domestic animals, at least four months of age, are housed or accepted for boarding, trimming, grooming and/or bathing for which remuneration is received.

    Laboratory/research. A facility equipped with materials and scientific and technological equipment designed for scientific experimentation, examination, evaluation, and documentation for medical and other technologies.

    Laboratory manufacturing. A facility for the on-site manufacturing processes used in chemical and associated laboratory manufacturing.

    Land use. A description of how land is occupied or utilized.

    Landscape.

    (1)

    An expanse of natural scenery.

    (2)

    Lawns, trees, plants and other natural materials, such as rock and wood chips, and decorative features, including sculpture, patterned walks, fountains, and pools.

    Lattice tower. A tower having three or four support steel legs and capable of supporting several types of antennas. These towers range from 60 to 200 feet in height and can accommodate a number of users.

    Lawn maintenance service shop. A facility for the maintenance of lawn equipment such as small engine repair and tune ups. Riding lawn mower repair, but no heavy equipment repair such as tractors. All repairs shall be made inside the facility.

    Leather and leather goods shop (see retail store). A shop that offers for sale to the general public leather and leather goods and accessories. Maximum floor area shall not exceed 2,000 square feet.

    Library. A place in which literary and artistic materials, as books and periodicals, are kept for reading reference or borrowing.

    Light fabrication and assembly process. A facility used for subassembly, or assembly of subassemblies for industrial purposes, generally not emitting noise, odor, dust or other hazards.

    Lithographer, printing, or blueprint plant. A large commercial printing shop with multiple presses and capabilities offering duplicating services including blueprinting and photostating.

    Living unit. Same as dwelling unit.

    Loading space, off-street. Space logically and conveniently located for bulk pickups and deliveries, scaled to delivery vehicles expected to be used, and accessible to such vehicles when required off-street parking spaces are filled. Required off-street loading space is not to be included as off-street parking space in computation of required off-street parking space.

    Lot. An undivided tract or parcel of land having frontage on a public street, or upon an approved open space, having direct street access, and which is, or in the future may be, offered for sale, conveyance, transfer, or improvement, which is designated as a distinct and separate tract, and which is identified by a tract or lot number or symbol in a duly approved subdivision plat which has been properly filed or recorded.

    Lot coverage. The percentage of the total area of a lot occupied by the base (first story or floor) of buildings located on the lot.

    Lot frontage. The length of street frontage between property lines.

    Lot lines. The lines bounding a lot as defined:

    (1)

    Front—The boundary between a lot and the right-of-way of the street on which it fronts.

    (2)

    Rear—The boundary line that is opposite and most distant from the front lot line. In the case of uncertainty the zoning administrator shall determine the rear lot line.

    (3)

    Side—Any lot boundary line not a front or rear lot line thereof. A side lot line may be a party lot line, a line bordering on an alley or place or side street line.

    Lot measurement.

    (1)

    Area of the lot shall be the net area of the lot, expressed in square feet or acreage, and shall not include portions of any public street or alley.

    (2)

    Depth of a lot shall be considered to be the distance between the midpoints of straight lines connecting the foremost points of the side lot lines in front and the rearmost points of the side lot lines in the rear (the mean horizontal distance between the front and rear lot line).

    (3)

    Width of a lot shall be considered to be the distance between straight lines connecting front and rear lot lines at each side of the lot, measured across the rear of the required front yard, provided however that width between side lot lines at their foremost points (where they intersect with the street line) shall not be less than 80 percent of the required lot width except in the case of lots on the turning circle of cul-de-sacs, where the 80 percent requirement shall not apply.

    Lot of record. A lot that is part of a subdivision recorded in the office of the County Clerk of Tarrant County Texas.

    Lot types. (See figure 28-1).

    Corner lot —A lot abutting upon two or more streets at their intersection.

    Interior lot —A lot other than a corner lot with only one street frontage and whose side lot lines do not abut upon any street.

    Through lot —A lot other than a corner lot with frontage on more than one street. Through lots abutting two streets may be referred to as "double frontage" lots.

    Cul-de-sac lots —A lot whose frontage is along the turn-around portion of a street that has only one opening and terminates with a turn-around at the closed end.

    Lumber yard. (See hardware, etc.)

    Machine or sheet metal facility. A facility that manufactures products primarily by machining and/or by forming metal and other materials.

    Massage Therapy Clinic: Any place of business in which massage therapy is practiced by a massage therapist, as defined and licensed by State law. "Massage therapy", as a health care service, means the manipulation of soft tissue for therapeutic purposes. The term includes, but is not limited to, effleurage (stroking), petrissage (kneading), tapotement (percussion), compression, vibration, friction, nerve strokes, and Swedish gymnastics, either by hand or with mechanical or electrical apparatus for the purpose of body massage. Massage therapy may include the use of oil, salt glows, heat lamps, hot and cold packs, tub, shower or cabinet baths. Equivalent terms for "massage therapy" are massage, therapeutic massage. Massage and "therapeutic" do not include diagnosis, the treatment of illness or disease, or any service or procedure for which a license to practice medicine, chiropractic, physical therapy, or podiatry is required by law.

    Massage Therapy, Unlicensed: Any place of business in which massage therapy is practiced by an unlicensed massage therapist. "Massage therapy", as a health care service, means the manipulation of soft tissue for therapeutic purposes. The term includes, but is not limited to, effleurage (stroking), petrissage (kneading), tapotement (percussion), compression, vibration, friction, nerve strokes, and Swedish gymnastics, either by hand or with mechanical or electrical apparatus for the purpose of body message. Massage therapy may include the use of oil, salt glows, heat lamps, hot and cold packs, tub, shower or cabinet baths. Equivalent terms for "massage therapy" are massage, therapeutic massage. Massage and "therapeutic" do not include diagnosis, the treatment of illness or disease, or any service or procedure for which a license to practice medicine, chiropractic, physical therapy, or podiatry is required by law. Acupuncture, acupressure, reflexology, and similar unlicensed therapeutic practices are included in this definition.

    Medical care facilities. Nursing and care homes; hospitals with their related facilities and supportive retail and personal service uses operated by or under the control of the hospital, primarily for the convenience of patients, staff, and visitors.

    Metal finishing facility. A facility which performs surface treatments and/or the application of immersion, anodic, electroless, electrolytic, flame, or vacuum deposited surface coatings regardless of type of application method and/or application of organic coating such as primers, paints, power coatings, dry film lubricants, or any other surface coating regardless of type or application method on metallic or other metals.

    Main (principal) building. The building or buildings on a lot that are occupied by the primary use.

    Mini-warehouses, without residential quarters for on-site resident manager. A totally enclosed facility involving one or more buildings that contain individual, compartmentalized and controlled access stalls or lockers of varying sizes not to exceed 600 square feet inside, designed and used for the purpose of individual storage spaces for tenants for the sole purpose of the dead storage of the tenants' goods, wares or personal property. No retail, wholesale, manufacturing, fabrication, service, repair, office, transfer/storage business or other business will be allowed. Additionally, the operation of power tools, spray painting equipment, table saws, lathes, compressors, welding equipment, kilns or similar equipment shall not be allowed. The storage of hazardous or flammable materials as designated by the fire marshal is expressly prohibited. No residential quarters for on-site resident manager are permitted.

    Mini-warehouses, with residential quarters for on-site resident manager.

    A totally enclosed facility involving one or more buildings that contain individual, compartmentalized and controlled access stalls or lockers of varying sizes not to exceed 600 square feet square feet inside, designed and used for the purpose of individual storage spaces for tenants for the sole purpose of the dead storage of the tenants' goods, wares or personal property. No retail, wholesale, manufacturing, fabrication, service, repair, office, transfer/storage business or other business will be allowed. Additionally, the operation of power tools, spray painting equipment, table saws, lathes, compressors, welding equipment, kilns or similar equipment shall not be allowed. The storage of hazardous or flammable materials as designated by the fire marshal is expressly prohibited. Residential quarters for on-site resident manager are permitted.

    Model home. A single family dwelling unit in a developing subdivision located on a legal lot of record that is limited to temporary use as a sales office for the subdivision and is used to provide an example of the dwellings which have been built or which are proposed to be built in the same subdivision.

    Monopole. An antenna facility composed of a single spire used to support communication equipment. No guy wires are used or permitted.

    Monument manufacturing. Manufacturing of monuments including sales and storage facilities.

    Mortuary. An establishment for the temporary reception of the dead, may provide embalming and burial services in conformance with state law.

    Mortuary, funeral home, and undertaker. An establishment providing for the final preparation of the dead and/or burial services in conformance with state law, retail sales of caskets, and burial material.

    Motorcycle and trailer sales, rental, or repair. An establishment that includes the display, and sale and/or rental of new and used motorcycles, and trailers with incidental parts sales, and maintenance and repair facilities.

    Moving or storage company. (See hauling and storage).

    Museum, library, fine arts center, and similar cultural facilities. Buildings and structures open for the general public, for which a fee may or may not be charged, for the use of book collections, cultural collections, or events such as art galleries, museums, live theater, and similar uses; owned and operated by the City, Tarrant County, or the State of Texas, or owned by such agencies and operated under their control and supervision.

    Musical instruments and supply. (See retail store). An establishment primarily engaged in the retail sale of musical instruments (including pianos), sheet music, and similar supplies.

    Natural gas compressor station. A facility utilizing compression equipment and facilities, including a gathering station and/or a compressor station, which compress natural gas and/or other hydrocarbons and associated byproducts for purposes of transporting such products through a pipeline.

    Nondepository financial institution means any check cashing business, payday/advance loan business, or car title loan business, as defined in this section. This definition excludes:

    a.

    A state or federally chartered bank, savings and loan association, or credit union, or a pawnshop;

    b.

    Any business that grants or brokers "tax refund advance" loans or other such loans whose value is based on the value of a federal income tax refund due to a consumer; and revenue generated on site.

    c.

    A convenience store, supermarket, or other retail establishment where consumer retail sales constitute at least 75 percent of the total gross revenue generated on site.

    Non-conforming building, lot or use. A building, lot, or use of land lawfully occupied at the time of the effective date of this ordinance or amendments thereto, and which does not conform to the building size and location on a lot, or the use regulations of the district in which it is situated. A use, building or lot established after the passage of this ordinance, which does not conform to regulations of the district in which it is situated, shall be considered an illegal non-conforming building, lot or use.

    Nursery yard or building for retail sales. An establishment offering plants grown on the premises and off the premises and associated products for sale, provided that all incidental equipment and supplies including fertilizer and empty containers are kept within a building.

    Nursing home. An institution providing meals and resident care and services for persons who are generally admitted for periods of time exceeding 30 days. Such service includes custodial or attendant care, but may or may not provide for routine and regular medical and nursing services. Nursing and care homes include homes for the aged, and convalescent and rest homes.

    Occupancy. The use or intended use of the land or buildings by proprietors or tenants.

    Office building, administrative. An office building to be used only for the administrative functions of companies, corporations, partnerships, social or philanthropic organizations, or societies.

    Office, business and professional. An office for the provision of business and professional services such as, accountants, architects, brokers, engineers, dentists, lawyers, physicians, osteopaths, chiropractors, real estate and insurance, not including retail sales or production.

    Office products sales and service. An establishment which offers for sale office products and office equipment such as but not limited to paper products, folders, staples, paper clips, note pads, binders, copy machines, fax machines, computers, typewriters, and similar items for offices and the service of such equipment.

    Office warehouse. The primary function of an "office warehouse" facility is the storage of goods and merchandise. Although a limited amount of retail and/or wholesale, and cash-and-carry sales will occur in an "office warehouse" facility, the majority of sales will be phone or mail orders to be delivered or shipped to the purchaser. The office portion of an "office warehouse" use would typically consist of management, accounting and order desk personnel.

    Off premises advertising signs. A surface whereon advertising matter (either commercial or non-commercial in nature) is set in view conspicuously and which said advertising does not apply to premises or any use of premises whereon it is displayed or posted.

    Open space. Area included in any side, rear or front yard or any unoccupied space on the lot that is open and unobstructed to the sky except for the ordinary projections of cornices, eaves or porches.

    Optometrist/optician's office. An establishment where patients can have a professional exam of the eyes and treatment of certain defects by means of corrective lenses.

    Orphanage. An institution for the care of orphans (children whose parents are dead) and other abandoned children.

    Outdoor storage of construction materials. An outdoor storage yard primarily engaged in the storage and wholesale distribution of construction material.

    Parking space, off-street. For the purposes of this ordinance, an off-street parking space shall consist of an indoor or outdoor space adequate for parking a vehicle with room for opening doors on both sides, together with properly related access to a public street or alley and maneuvering room.

    Parks, playgrounds, community centers, or recreational areas. Areas and structures owned and operated by the City, Tarrant County, or the State of Texas or owned by such agencies and operated under their control and supervision to be used by the general public with or without a fee for their use, for general recreational purposes.

    Parking, commercial lot or garage. An establishment primarily engaged in the temporary parking of automobiles, usually on an hourly, daily, or monthly contract or fee basis.

    Paved surface. A permanent surface that will support fire department apparatus and is constructed of asphalt, concrete, pave stone, brick or other similar materials having the same strength and durability. Such surface shall drain appropriately, remain water resistant, free of litter, debris, weeds, grass or other objectionable materials or objects and is visibly dust free.

    Pawn shop. A building or premise (other than a bank, savings and loan, or mortgage banking company) used for the business of lending of money on the security of pledged goods, or for the business of the purchase of tangible personal property on condition that it may be redeemed or repurchased by the seller for a fixed price within a fixed period of time.

    Payday/advance loan business means an establishment, entity or person registered with the Texas Secretary of State as a Credit Services Organization (CSO) under V.T.C.A., Texas Finance Code § 393 that engages in any of the following activities:

    1.

    Acts or operates as a loan broker between a consumer and a lending company;

    2.

    Issues a "letter of credit" or similar document on behalf of a consumer to a lending company;

    3.

    Collects any or all of the following fees:

    i.

    A referral fee for referring a consumer to a lending company;

    ii.

    An application fee for filling out the CSO documents; or

    iii.

    Interest on the funds distributed to the consumer, or payments based on the amount of money distributed to the consumer; or

    4.

    Requires the consumer to provide the CSO or lending company with a postdated check or authorization to make an electronic debit against an existing financial account.

    Permitted uses. Any use allowed in a zoning district and subject to the restrictions applicable to that zoning district.

    Pest control service shop. (See contractor's service).

    Petroleum collection/storage facility. A facility that accepts small amounts of used oil and store it until enough is collected to ship it elsewhere for recycling.

    Pet shop or adoption center. An establishment that offers for sale or adoption small domestic pets, with associated goods and services with no outside kennels or pens.

    Photograph, portrait or camera shop, studio, and photo supply. An establishment engaged in still or video portrait photography and/or retail sale of cameras, film, and other photographic supplies and equipment to the general public. May also provide for film editing, developing, and processing.

    Planning and zoning commission. The agency appointed by the city council as an advisory body to it and which is authorized to recommend changes in the zoning ordinance and fulfill the functions authorized by the city council and state law.

    Plant nursery (wholesale). A facility which sells plants to a specialized buyer such as a landscape contractor or retail business. Outside storage of plants and bulk products occurs.

    Plat. A plan of a subdivision of land creating building lots or tracts and showing all essential dimensions and other information essential to comply with the subdivision standards of the City of Haltom City and subject to approval by the planning and zoning commission. Reference to a plat in this ordinance means an official plat of record that has been approved by the planning and zoning commission and filed in the plat records of Tarrant County.

    Pool or billiard hall. An establishment engaging in providing facilities for pool and/or billiards.

    Portable storage building. A portable accessory building used for storage see section 29, Supplemental district regulations.

    Post offices, government buildings and facilities, and other government uses not otherwise permitted. Governmental offices include post offices, utility administrative offices, governmental facilities, and other governmental uses.

    Power generation plants and facilities. Establishments primarily engaged in power generation through the use of various electric power generation methods.

    Private club. An association of persons meeting regularly for their mutual benefit or for the promotion of some common purpose supported jointly through payment of membership dues; and regulated by the Texas Alcohol Beverage Code in such instances where alcoholic beverages are sold to members.

    Premises. Land together with any buildings or structures occupying it.

    Private drive (street or place). An open, unoccupied space, other than a public street or alley, permanently established or reserved or dedicated in private ownership as the principals of vehicular access to property abutting thereon.

    Public building. Any building, structure, facility, or complex used by the general public, whether constructed by any state, county, or municipal government agency or instrumentality or any private individual, partnership, association or corporation, including, but not limited to assembly buildings, such as auditoriums, libraries, public eating places, schools, and theaters; business buildings such as offices; and factories and industrial buildings.

    Public safety facility. A facility designed to provide public protection from the dangers of fire and crime, including civil defense operational centers, police and fire stations, and training facilities.

    Publishing company. An establishment offering reproduction services for the production of books, magazines, newspapers and other published materials.

    Race track (animal). A purpose built facility for the conducting of animal races (e.g. horseracing or greyhound racing).

    Radio and television studio. A facility designed to create and broadcast original source programming, or relay commercial programming from one source, including taped or prerecorded materials for any part of the radio spectrum for commercial consumption.

    Radio and television sales and service (see retail store). An establishment that primarily sells and provides repair service for radios, stereos, televisions and other similar products to the general public.

    Real estate sales office (temporary) (see section 29). The temporary provision of real estate services for property located within the subdivision in which it is located. The following provisions shall apply:

    (1)

    These services may be located within a model home, a temporary HUD code manufactured home, or an industrialized housing unit.

    (2)

    This use shall cease within 30 days of sale of the last lot in the subdivision or within five years, whichever occurs first.

    (3)

    This use shall meet the requirements of section 36, Conditional uses.

    (4)

    Sales offices shall require payment of an annual permit fee, to be established by the city council.

    (5)

    Field offices for the sale or rental of real estate shall be removed upon request of the city manager or his designee.

    (6)

    Sales offices shall not be used for the sale of property outside of the subdivision in which it is located.

    Recreational vehicles, major. For purposes of these regulations, major recreational vehicle is defined as including boats, trailers and boat trailers, travel trailers, pick-up campers or coaches (designed to be mounted on automotive vehicles, but excluding pickup shells not designed or used for camping purposes), motorized dwellings, tent trailers, horse trailers, utility trailers, and the like, and cases or boxes used for transporting major recreational vehicles, whether occupied by such vehicle or not.

    Recreational vehicle storage. A facility providing for the parking and storage of recreational vehicles.

    Reclamation center. An establishment that collects solid waste products.

    Recycling transfer station. A facility designed to collect, sort and package, by manual or mechanical processes, recyclable items for transport to a reprocessing plant.

    Rehabilitation care facility (psychiatric and mental disorders). A facility which provides residence and/or out-patient care, with supervisory personnel, to persons regardless of legal relationship, who have demonstrated a tendency toward mental illness.

    Rehabilitation care facility (substance abuse). A facility that provides residence and/or out-patient care, with supervisory personnel, to persons regardless of legal relationship, who have demonstrated a tendency toward alcoholism and/or drug abuse.

    Rehabilitation care facility (Criminal—Psychiatric, mental disorder and substance abuse). A facility which provides residence and/or out-patient care, with supervisory personnel, to persons regardless of legal relationship, who have been involved in the criminal justice system or related program including parole or probation as authorized by the criminal justice system, and have demonstrated a tendency toward alcoholism, drug abuse, mental illness, or antisocial or criminal conduct.

    Religious institution. An institution that people regularly attend to participate in or hold religious services, meetings and other activities. The term church shall not carry a secular connotation and shall include buildings in which the religious services of any denomination are held.

    Rental store (without outside storage). An establishment that provides equipment and goods for rent by the general public to be used off site. All storage of rental equipment and goods shall be contained within the limits of the primary structure.

    Rental yard (domestic goods with outside storage). An establishment that provides domestic equipment and goods for rent by the general public to be used off site. The storage of rental equipment or goods may occur either within the limits of the primary structure or displayed and stored on outside of the primary structure, not to include backhoes, front-end loaders, and tractors.

    Rental yard for commercial and heavy equipment (with outside storage) (see section 29). An establishment that provides heavy equipment for rent by contractors or the general public to be used off site.

    Residence. Same as a dwelling; also when used with the word district, an area of residential regulations.

    Residential quarters within a building or structure otherwise permitted within the district. A residential use located within the building or structure of a non-residential use where such quarters are occupied by an owner or employee of a business occupying some or all of the remainder of the building or structure where living facilities are distinctly separate from and secondary to the non-residential structure or use.

    Residential quarters for an employee serving as a night watchman or security guard. A residential use located on the premises with a main non-residential use.

    Restaurant, drive-in. Any place or premises where food or beverages are prepared on site and served to customers in their vehicles to be consumed on premises or taken off premises.

    Restaurant, fast food. An establishment primarily designed and constructed for customers, to be served food at a counter, to be consumed on the premises or for carry-out for off-premises consumption, said establishment utilizing drive thru windows for distribution of carry-out orders as a primary use.

    Restaurant or cafeteria. An establishment whose primary business is food service to the general public in designated dining areas. An establishment's primary business is considered to be food service if the gross receipts of food sold by the establishment are 50% or more of the total gross receipts from the establishment.

    Retail store. An establishment engaged in selling goods or merchandise to the general public for personal or household consumption and rendering services incidental to the sale of such goods.

    Retail store with light manufacturing. An establishment performing custom work or the manufacturing of articles to be sold on the premises. Provided that in such manufacture the total mechanical power shall not exceed five horse power for the operation of any one machine, provided that the space occupied by the manufacturing use permitted herein shall not exceed 50 percent of the total floor area of the permitted use. Provided further that such manufacturing use is not noxious or offensive by reason of vibration, noise, odor, dust, smoke or fumes, and all activities shall be conducted totally within the same building.

    Right-of-way. An area or strip of land, either public or private, on which an irrevocable right-of-passage has been recorded by plat or separate instrument for the use of vehicles or pedestrians or both.

    Rodeo. A cattle roundup or a public show featuring cowboy skills and competitions.

    Room. A building or portion of a building that is arranged, occupied or intended to be occupied, as living or sleeping quarters, but not including toilet or cooking facilities.

    Sanitary landfill. An establishment primarily engaged in the collection and disposal of refuse in a landfill.

    Satellite receive-only antenna. An antenna that enables the receipt of television or video signals transmitted directly from satellites to be viewed on a television monitor. Such antennas are commonly known as a satellite dish, television receive-only antennas, dish antennas, parabolic antennas or satellite earth station antennas.

    School, commercial business college. A business organized to operate for a profit and offering instruction and training in a service or art such as secretarial school, barber college, beauty school, or commercial art school, but not including manual trade schools.

    School, commercial trade. A business organized to operate for a profit and offering instruction and training in a manual trade such as air conditioning repair, auto mechanics, or truck driving.

    School, higher education. An academic institution of higher learning, accredited or recognized by the State of Texas and offering a program or series of programs of academic study leading to a recognized degree or advanced degree.

    School, public/private, and parochial-elementary, and secondary. A facility (public or private) that provides a curriculum of elementary and secondary academic instruction, including kindergartens, elementary schools, junior high schools, and high schools that is operated by any governmental unit existing pursuant to the laws of the State of Texas or any privately operated educational facility providing a formal educational program as a substitute for public educational programs. This use does not include correctional institutions or trade schools. Temporary buildings, for use as classroom buildings on property used as a public elementary or secondary school, are permitted under this use under the following conditions:

    (1)

    The temporary classroom buildings are on property used for the main structure of a public elementary or secondary school;

    (2)

    The property does not have temporary classroom buildings located on it for more than five consecutive years; and

    (3)

    Temporary classroom buildings may remain on the property of a public elementary or secondary school more than five consecutive years only if the school district obtains a special exception from the board of adjustment.

    Screening device. A fence, wall, or other conventional device or combination of conventional devices constructed of new wood, masonry, or stone material which are solid and provide a durable opaque screen without holes, penetrations or other openings other than those required for passage and which is designed to prevent persons from seeing through. Screening device may include shrubs or other live material achieving an opaque effect, subject to the approval of the zoning administrator.

    Senior citizen center. A facility which addresses the basic essential needs of older adults through special programs and services.

    Setback. The minimum horizontal distance between the front wall of any projection of the building, excluding steps and unenclosed porch, and the street line. (Same as "building line").

    Shopping center. A group of commercial establishments planned, constructed, and managed as a total entity, with customer and employee parking provided on site, provisions for goods delivery separated from customer access, aesthetic considerations and protection from the elements, and landscaping and signage in accordance with an approved plan.

    Shopping mall. A shopping center with stores on both sides of an enclosed or open pedestrian walkway.

    Showroom warehouse. A sales and office facility for a product that by nature of the bulk dimensions of the product requires a larger than normal storage area ratio to sales and office area to maintain a normal operating product inventory. A showroom warehouse is specifically not intended to be a wholesale distribution center. All activities and storage shall be totally within an enclosed building; a maximum of 80 percent of the gross floor area of any unit or multiple unit facility shall be used for warehouse activity; and no manufacturing, fabrication or assembly operation shall be conducted in any part of any unit except for articles to be sold at retail on the premises.

    Showroom warehouse with fabrication. A sales and office facility for the fabrication, display, and sale of a product that by nature of the bulk dimensions of the product requires a larger than normal storage area ratio to sales and office area to maintain a normal operating produce inventory. A showroom warehouse with fabrication is specifically not intended to be a wholesale distribution center.

    Shuttle and taxi service. An enterprise that provides transportation services for the general public, generally, on a cost per trip basis. This use typically involves the dispatching, maintenance, and storage of vehicles used for the service and includes automobiles and vans but does not include buses.

    Sign. See definition in sign ordinance.

    Sign shop. (See lithographer).

    Skating rink, ice and roller. An establishment featuring either roller or ice skating facilities located within a completely enclosed building.

    Smoke lounge. An assembly establishment that is dedicated, in whole or in part, to entertaining smokers of tobacco, electronic vaping devices or other similar substances and includes any establishment that allows either the payment of consideration by a customer to the establishment for on-site delivery of tobacco, tobacco accessories, electronic vaping devices, vapor accessories or similar substances and products to the customer; and, the onsite smoking of such. This definition shall be construed to include establishments known variously as retail tobacco stores, tobacco product shops, hookah cafes, tobacco clubs, tobacco bars, vapor shops/lounges, and similar establishments, but shall not include an establishment which derives more than 50 percent of its gross revenue from food, beverage, or gasoline fuel sales.

    Smoke shop. A retail establishment that is dedicated, in whole or in part, to the smoking of tobacco, electronic vaping devices or other similar substances and includes any establishment that allows either the payment of consideration by a customer to the establishment for on-site delivery of tobacco, tobacco accessories, electronic vaping devices, vapor accessories or similar substances and products to the customer; and, the onsite smoking of such. This definition shall be construed to include establishments known variously as retail tobacco stores, tobacco product shops, vapor shops, and similar establishments, but shall not include an establishment which derives more than 50 percent of its gross revenue from food, beverage, or gasoline fuel sales.

    Solid waste convenience center. (See reclamation center).

    Special exception. A special exception is a use that would not be appropriate generally or without restriction throughout the zoning district but which, if controlled as to number, area, location or relation to the neighborhood, would be wholly compatible with conditions affecting the public health, safety, welfare, morals, order, comfort, convenience, appearance, prosperity or general welfare. Such uses may be permitted in such zoning district as special exceptions if approved by the board of adjustment (see section 35).

    Sporting goods including gun sales and repair. An establishment primarily engaged in the retail sale of sporting goods, guns and ammunition, sporting equipment, bicycles, bicycle parts, and accessories.

    Stable, riding and hall. An establishment providing for the quartering of horses, for the purpose of riding. This use may also include a fully enclosed structure providing for the riding of horses.

    Stable/barn, commercial. A lot that may be used for commercial riding stable open to the general public; boarding of livestock not involved with current breeding or training; training involving large groups of eight or more students. A building where horses and ponies are sheltered, fed, and/or kept for hire. A commercial stable shall meet the provisions of the applicable zoning district and the conditions of the ordinance.

    Stable and barn, private (see section 29). An accessory building for the shelter and protection of livestock (horse, pony, mule, donkey, sheep, goat, or cow) subject to the following:

    (1)

    One head of livestock may be kept in a private stable or barn on a lot or tract of land under one ownership containing a minimum of 20,000 square feet.

    (2)

    One additional head of livestock may be kept in the private stable or barn subject to the lot or tract containing an additional 10,000 square feet of land area for each additional head of livestock.

    (3)

    The maximum size of such private stable or barn shall be 1,250 square feet.

    (4)

    The private stable or barn shall not be within 100 feet of adjacent residential, commercial, or other inhabited structures, and shall meet the other provisions of the animal control ordinance.

    Storage or processing of junk or salvage material. An establishment primarily engaging in the storage, assembling, breaking up, sorting, or retail and wholesale distribution of scrap or waste materials.

    Storage of stone, rock or gravel. A facility with an outside storage yard primarily engaged in the storage and wholesale/retail distribution of containerized rock, stone or gravel.

    Storage warehouse distribution. A building used primarily for the storage of goods and materials and available to the general public for a fee.

    Story. That part of a building included between the surface of one floor and the surface of the floor next above, or if there be no floor above, that part of the building which is above the surface of the highest floor thereof. For the purpose of computing building height pursuant to this ordinance, the average height for a story shall be defined as 12 feet six inches.

    Street. A public way between two right-of-way lines, other than an alley or private drive, which has been dedicated or deeded to the public for public use and affords a principal means of access (vehicular or otherwise) to property abutting thereon, as well as for utilities and sidewalks.

    Street line. The right-of-way of a street.

    Structure, permanent. Anything constructed or erected with a permanent foundation on the ground, or structurally attached to something having a permanent foundation on the ground. Permanent structures include buildings, walls, fences, billboards, antennas and towers.

    Structure, temporary. Anything constructed, erected, or placed on the ground, in such a manner that it may be moved, hauled, loaded, or otherwise transported without significant disassembly. Among other things, temporary structures include mobile homes, sheds, and anything fitted with wheels or sleds used for transportation.

    Structural alterations. Any change in the supporting members of a building, such as bearing walls, columns, beams or girders, or any substantial changes in the roofs or exterior walls, excepting such repair or replacement as may be required for the safety of the building, but not including openings in bearing walls as permitted by the city building code.

    Studio for artists. An establishment of a professional artist or photographer offering services to the general public.

    Swimming pool sales and service store. (See showroom warehouse).

    Subdivision. The process of dividing a parcel of raw land into smaller buildable sites, blocks, lots, streets, and other public areas and rights-of-way which results in a final plat which graphically depicts the above items.

    Supporting business. A secondary use such as a newsstand, barber or beauty shop, drugstore, gift shop, clothing shop, book store, florist, travel agency, or stockbroker, located within a structure principally housing a primary use such as a hotel, motel, apartment hotel, hospital, nursing and care homes, office complex, or other permitted use for the convenience of employees, patients, staff, and visitors.

    Tattoo and/or Piercing Studio: An establishment whose principal business activity, either in terms of operation or as held out to the public, is the practice of one or more of the following: (1) placing of designs, letters, figures, symbols, or other marks upon or under the skin of any person, using ink or other substances that result in the permanent coloration of the skin, by means of the use of needles or other instruments designed to contact or puncture the skin; (2) creation of an opening in the body of a person for the purpose of inserting jewelry or other decoration.

    Temporary building used for construction purposes only. A temporary construction building to be utilized during the construction of permanent structures.

    Temporary employment agency. An agency that specializes in finding strictly temporary workers for a variety of tasks (usually clerically related) for short term employment with a firm or business. A "day laborer" site is not to be included in this use definition.

    Thoroughfare. As defined in the city's latest approved comprehensive plan and thoroughfare plan.

    Tire and battery sales store. A facility where tires and batteries are sold, services such as tires and wheels are changed, and light maintenance activities such as wheel alignment and wheel lubrication are conducted. Services shall not include heavy automobile maintenance activities such as but not limited to engine overhauls, automobile painting, body, and/or fender work.

    Tobacco store (see retail store). A business establishment offering for sale cigar, cigarettes, and other tobacco products and accessory products for retail sale.

    Tower. A monopole or lattice tower.

    Townhouse. A single family dwelling facility constructed in a series, or group of units having common walls, each on a separate lot of record.

    Travel trailer. A mobile vehicle built on a chassis and designed and used as a temporary place of dwelling and of such size and design as to be subject to licensing for towing on the highway by a passenger motor vehicle or other prime mover and not requiring a special permit for moving on the highway as contrasted to a mobile home.

    Truck service center. A facility involving the maintenance, servicing, parking or repair of commercial trucks. Dispensing of motor fuel or other petroleum products directly into the trucks and the sale of accessories or equipment may occur.

    Unskilled Worker. An individual who performs labor involving physical toil that does not require persons engaged in a particular occupation, craft, or trade. An unskilled worker includes a temporary common worker as defined by state law.

    Upholstery shop. A shop for the repairing or replacing and upholstering of furniture. This does not include automotive upholstering.

    Utility buildings and structures. Buildings and structures utilized for power substations, water tanks. and reservoirs, water and sewerage treatment plants and telephone exchange.

    Variance. A variance is a relaxation of the terms of the zoning ordinance where such variance will not be contrary to the public interest and where, owing to conditions peculiar to the property and not the result of the actions of the applicant, a literal enforcement of the ordinance would result in unnecessary and undue hardship. As used in this ordinance, a variance is authorized only for height, area, and size of structure, the size of yards and open spaces, or other development regulations. Establishment or expansion of a use otherwise prohibited shall not be allowed by variance, nor shall a variance be granted because of the presence of non-conformities in the zoning district or uses in an adjoining zoning district.

    Variety store (see retail store). An establishment primarily engaged in the retail sale of a variety of merchandise in the low and popular price range. Sales usually are made on a cash and carry basis, with the open-selling method of display and customer selection of merchandise. These stores generally do not carry a complete line of merchandise, are not departmentalized, do not carry their own charge service, and do not deliver merchandise.

    Vehicle. Every device in, upon, or by which any person or property is or may be transported or drawn upon a street or highway, except devices manufactured, built, or fabricated with sole purpose and intent of being moved exclusively by human power, and shall include without limitation automobiles, motorcycles, trailers, and recreational vehicles.

    Vehicle storage facility. A facility that is used to house and/or store vehicles. Includes structures generally called garages, boathouses, and airplane hangars. Vehicles may include automobiles, trucks, forklifts and other powered transport devices. This excludes parking garages and parking lots.

    Veterinarian clinic (w/kennels). A facility for the prevention, treatment, minor surgery, cure or alleviation of disease and/or injury in animals, specifically domestic animals, with all care provided on an out-patient treatment basis only. Over-night boarding of animals shall be allowed.

    Veterinarian clinic (w/o kennels). A facility for the prevention, treatment, minor surgery, cure or alleviation of disease and/or injury in animals, specifically domestic animals, with all care provided on an out-patient treatment basis only. No over-night boarding of animals shall be allowed.

    Warehouse and wholesaling. An establishment primarily engaged in the warehousing, storage, and wholesaling of a general line of goods.

    Water supply or wastewater treatment, storage or discharge facility. A facility used to treat, prepare, store, and distribute or collect water or wastewater for domestic use or disposal for the general public, usually owned and operated by a governmental organization.

    Welding or machine shop. A facility for the machining or welding of metals, but not including forging.

    Wrecker/towing service. A facility which provides towing of wrecked or disabled vehicles and charges a fee for its service and as defined in chapter 94 of this Code.

    Wrecking/auto salvage yard. A facility which stores and displays vehicles which are wrecked, partially dismantled or discarded: and/or iron, metal, glass, or second hand material which has been a part or is intended to be a part of a vehicle and as defined in chapter 50 of this Code.

    Xeriscape. A combination of landscape features and techniques that in the aggregate reduce the demand for and consumption of water, including appropriate low-water-using plants, non-living ground cover, a low percentage of lawn coverage, a high degree of paving permeability, and water-conserving irrigation techniques and systems.

    Yard. A required open space other than a court unoccupied and unobstructed by any structure or portion of a structure from 30 inches above the general ground level of the graded lot upward, provided however that fences, walls, poles, posts, and other customary yard accessories, ornaments, furniture, and roof overhangs not exceeding 30 inches, may be permitted in any yard subject to height limitations and requirements limiting obstruction of visibility.

    Yard—front. A yard extending between side lot lines across the front of a lot adjoining a public street.

    (1)

    Through lots—In the case of through lots, unless the prevailing front yard pattern on adjoining lots indicates otherwise, front yards shall be provided on all frontages. Where one of the front yards that would normally be required on a through lot is not in keeping with the prevailing yard pattern, the zoning administrator may waive the requirement for the normal front yard and substitute therefore a special yard requirement which shall not exceed the average of the yards provided on adjacent lots.

    (2)

    Depth—Depth of required front yards shall be measured at right angles to the front lot line being the street right-of-way line and/or the greatest length of lot line which is located on that side of any building considered to be the primary frontage.

    Yard—Side. A yard extending from the rear line of the required front yard to the rear lot line, or in the absence of any clearly defined rear lot line to the point on the lot farthest from the intersection of the lot line involved with the public street. In the case of through lots, side yards shall extend from the rear lines of front yards required. In the case of corner lots, yards remaining after full- and half-depth front yards have been established shall be considered side yards.

    Width of a required side yard shall be measured in such a manner that the yard established is a strip of the minimum width required by zoning district regulations with its inner edge parallel with the side lot line.

    Yard—Rear. A yard extending across the rear of the lot between inner side yard lines. In the case of through lots there will be no rear yards, but only front and side yards. All other lots will have rear yard.

    Depth of a required rear yard shall be measured in such a manner that the yard established is a strip of the minimum width required by district regulations with its inner edge approximately parallel with the rear lot line.

    Yard—Special. A yard behind any required yard adjacent to a public street, required to perform the same functions as a side or rear yard, but adjacent to a lot line so placed or oriented that neither the term "side yard" nor the term "rear yard" clearly applies. In such cases, the zoning administrator shall require a yard with minimum dimensions as generally required for a side yard or a rear yard in the district, determining which shall apply by the relation of the portion of the lot on which the yard is to be located to the adjoining lot or lots, with due regard to the orientation and location of structures and buildable areas thereon.
