§ 21. "C-3" commercial district.

  • A.

    Purpose. This commercial zoning district is intended to provide for the development of commercial uses, office parks, restricted light industry, and their related facilities. Appropriate standards for the varied uses are designed to assure compatibility with other acceptable uses.

    1.

    To provide sufficient space at appropriate locations, to meet the need of the city's projected requirements for all types of distributive, commercial and related activities, with due allowance for the need for choice of suitable sites.

    2.

    To protect distributive, commercial and related activities, as well as residential and related activities by providing for the separation of these uses; to insure that appropriate space needs for distributive and commercial activities are available by prohibiting the use of such space for residential purposes.

    3.

    To restrict those commercial activities which involve danger of fire, explosions, toxic or noxious matter, radiation, smoke, dust or other particulate matters, and other hazards, or create offensive noise, vibration, heat, humidity, glare, and other objectionable influences, to areas where this ordinance restricts the emission of such nuisances, without regard to the products or processes involved.

    4.

    To protect commercial activities and related developments against congestion, as appropriate for each area, by limiting the bulk of building in relation to the land around them and to one another, and by requiring off-street parking and loading facilities to be provided with such developments.

    5.

    To promote the most desirable use of land and direction of building development, to promote stability of commercial and related development, to strengthen the economic base of the City of Haltom City, to protect the character of these districts and their peculiar suitability for particular uses, and to conserve the value of land and buildings.

    B.

    Use regulations. In the "C-3" commercial district, no buildings or land shall be used or undertaken, and no building shall be hereafter erected, placed, reconstructed, altered or enlarged, unless otherwise provided in this ordinance.

    C.

    Permitted uses. Any use indicated as permitted in this district on the use matrix, section 9.

    D.

    Special exception uses. Special exception uses when authorized by the board of adjustment under the provisions of section 35, board of adjustment.

    E.

    Site plan required. A site plan meeting the requirements of section 30, site plan requirements, shall be required for each development application for any permitted use in this district.

    F.

    District restrictions. Unless otherwise specifically provided in this section, the following restrictions shall apply to this district.

    1.

    Any lighting visible from outside the site shall be designed to reflect away from adjacent residential districts. No noise, odor or vibration shall be emitted so that it constitutes a nuisance that substantially exceeds the general level of noise, odor, or vibration emitted by uses adjacent to or immediately surrounding the site. Such comparisons shall be made at the boundaries of the site.

    2.

    Outdoor storage of trash receptacles shall be at the side or rear of the site and shall be totally encircled or screened by a fence, planting or other suitable visual barrier.

    3.

    No inoperable vehicles may be stored over 24 hours unless inside a building or behind an approved screening device.

    4.

    All repairs and maintenance to vehicles must be made under roof or canopy unless said repair or maintenance is completed within three hours. This provision shall not apply to recreational vehicles.

    5.

    Operable vehicles parked in an unscreened area are required to have a valid state license and inspection sticker.

    6.

    No parts of any vehicle will be stored outside the business unless they are behind an approved screening device. This provision shall not apply to accessories displayed for sale.

    G.

    Development criteria. Unless otherwise specifically provided in this section, the following development criteria shall apply to this district:

    1.

    Every use, or any part thereof, that is not conducted within a building completely enclosed on all sides shall be enclosed within a wall or fence a minimum of six feet and a maximum of eight feet in height. Such wall or fence shall completely screen up to eight feet in height all operations conducted within such wall or fence from observation. No exterior storage area shall encroach into any of the required yards.

    2.

    The first 15 feet of the required front yard setback, measured from the property line shall be landscaped with trees, grass and shrubs, provided with pedestrian walks to the front of the building and maintained in a neat and attractive condition. The balance of said required setback may be utilized for off-street parking.

    3.

    No loading or storage of material or products shall be permitted in the required front yard.

    H.

    Area requirements.

    Minimum lot area: None
    Minimum floor area: None
    Minimum lot width: Must be the width (30') of the front yard
    Minimum lot depth: None
    Minimum front yard: 30 feet
    Minimum side yard: None (15' adjacent to residential zoning)
    Minimum rear yard: None (20' adjacent to residential zoning)
    Corner lots: 15 feet - intersecting street
    Maximum lot coverage: 50%
    Floor area ratio (FAR): 1.5:1
    Height: 45 feet (35' within 100' of residential zoning)

     

    I.

    Screening devices. In the event that this district abuts or adjoins a lot zoned "SF-1", "SF-2", "D", "TH", "MF-1", or "MF-2", a screening device meeting the requirements of section 32, landscaping and screening requirements shall be placed along the abutting or common property line.

    J.

    Parking requirements. See section 31, parking regulations.

    K.

    Accessory and temporary buildings and uses. See section 29, supplementary district regulations.

    L.

    Landscape requirements. See section 32, landscaping and screening requirements.

    M.
